GENERAL CONDITIONS FOR THE ONLINE SALE OF PRODUCTS AND SERVICES BETWEEN ADRIANNE AND USERS (hereinafter, “GENERAL CONDITIONS”)

1. GENERAL CONDITIONS PRIOR TO THE CONTRACT

c) ADRIANNE may unilaterally modify, at any time it deems appropriate, the configuration and content of these General Conditions. Notwithstanding this, the General Conditions applicable to a certain transaction will be those in force at the time of its formalization.

d) The terms and conditions applicable to the purchase of the Products offered for sale to the public by ADRIANNE through its Website www.adriannemadeinspain.com will be all those that are described in these General Conditions and that They will be detailed on the Website throughout the online purchase process. Through the use of the Website, users declare that they know and accept the different procedures necessary to access the different Products offered on the Website as well as formalize their purchase.

4. PRODUCTS OFFERED

a) ADRIANNE will publish, together with the image of each one of the Products that are sold through the Website, the specific characteristics of each one of them and the applicable sale price.

b) ADRIANNE guarantees that the price of the Products will be the one in force on the day of the formalization of the purchase regardless of the day on which the delivery of the order is formalized.

c) If there are applicable offers on the price of the Products, these will be indicated next to the initial price with a different typeface that allows the Client to clearly identify the final price of the Product. In any case, the temporary period of validity of the offer will be indicated.

d) ADRIANNE may, unilaterally and at any time, offer new Products that are sold on the Website as well as suspend or cancel, temporarily or indefinitely, any of the products.

e) The prices established on the Website will include the VAT applicable to each product as well as any other applicable tax. ADRIANNE undertakes to keep the prices updated in accordance with the applicable tax at all times.

5. PURCHASE SYSTEM

a) The Client must select the chosen product that he wishes to purchase and the quantity thereof. This operation must be viewed in "my account" and fill in the requested information. The purchase procedure will be in Spanish and English.

6. BILLING AND PAYMENT METHOD

7 DELIVERY, SHIPPING AND COSTS

c) Distribution areas: ADRIANNE will distribute its products throughout the international territory.

d) Transport costs: national orders have FREE shipping (including the Balearic Islands, Canary Islands, Ceuta and Melilla). For orders from foreign countries, contact us directly at info@adriannemadeinspain.com.
The above delivery costs may be reduced or even eliminated in the event of special promotions that, eventually or temporarily, ADRIANNE may establish on said costs , and provided that it expressly communicates it to its clients.
The expenses derived from customs, tariffs and/or other similar taxes will be borne by the client.

e) Delivery period: The Products will be delivered to the address indicated by the Client within a maximum period of 30 days from the date of receipt of payment. For orders from foreign countries, contact us directly at info@adriannemadeinspain.com.

8. DEFECTIVE PRODUCTS

a) If, at the time of its delivery to the Client by ADRIANNE, the Product presents defects or lacks in conformity with what was agreed between the Parties, the Client may request ADRIANNE in a reasoned manner to replace the Product, except that this was objectively impossible or disproportionate in accordance with the applicable legislation. The communication will be made in accordance with the provisions of Section 9 below.

b) The Client must inform ADRIANNE about the existence of the aforementioned lack of conformity within two (2) months from when he became aware of them.

d) If the existence of non-conformities in the Product is confirmed, ADRIANNE will replace it at no cost to the Customer, within a reasonable period of time that will not exceed fifteen (15) days after collection. of the Product by ADRIANNE. In the event that it is not possible to replace the Product, the Customer may choose between (i) requesting a price reduction proportional to the lack of conformity existing in the Product or (ii) terminating the Contract. Notwithstanding this, the resolution will not proceed when the lack of conformity of the Product is of minor importance, in accordance with the applicable regulations.

9. RIGHT OF WITHDRAWAL OF ORDERS. EXCHANGES AND RETURNS.
In the products offered on this website, the User has a period of 14 calendar days to withdraw from the contract made, proceeding to the refund of the amounts collected as appropriate for this purpose. The refund to the customer will be through the same payment method used by the customer at the time of making the initial purchase transaction. The period of 14 days will count from the receipt of the Product at the address selected by the buyer.
The right of withdrawal will not apply to personalized items.

In the event that the reason for the return is the poor condition of the product or having received the wrong product, the return will be made without any additional cost. In any other case, the costs caused by the return will be borne by the client.

To return or exchange an item purchased at ADRIANNE, the process to follow is as follows:

1. Request a return or exchange by email to info@adriannemadeinspain.com within a period not exceeding 14 calendar days following the date of receipt of the item. To help us continue to improve, we appreciate you indicating the reason for the return. No changes or returns will be accepted for personalized items.

2. In exchanges or returns, items must be sent in their original condition, including labels, cards and packaging, and in conditions that show that the product has not been used, washed or damaged.

Do I have to pay anything for my return / exchange?

ADRIANNE only assumes the shipping costs in the following cases:
Change of product in general (only in the peninsula).
Wrong shipments or defective products.

For all other returns, shipping costs are borne by the customer. In the case of special promotions, where the shipping costs have been free, the customer must assume the transport costs of the return or exchange.

How will I receive the amount of my refund?

Yes, you have the following options:

13. PERFECTION OF CONTRACTS.
The validity of contracts entered into electronically is protected by article 23, sections 1 and 3, of Law 34/2002 on Services of the Information Society and Electronic Commerce : «Contracts entered into electronically will have the same validity and will produce all the effects of the Civil and Commercial Legal System.»
The Contract is perfected from the moment the client expresses his agreement with these contracting conditions by pressing the Acceptance and Reading button of said conditions and after having correctly completed the form offered from the web server www.adriannemadeinspain.com or also by depositing or remitting said acceptance by any other electronic or traditional means at the headquarters offices .
After said acceptance, the client will receive notification from www.adriannemadeinspain.com automatically sent to the email address that provided in the Registration phase. This email will be sent within 24 hours and will show the information related to your registration and the selected contracting modality with the specific conditions that apply to each modality at any time and that are accepted together with these general conditions at the moment of recruitment. However, and in the case of a technical and automatic element, the reception of said email may not take place due to technical reasons beyond the control of www.adriannemadeinspain.com. In these cases, the client must contact our customer service to make the shipment effective.
The client agrees that it will not be necessary to confirm receipt of the acceptance of the contract when it has been concluded exclusively through exchange of email or other equivalent type of electronic communication, as established in article 28.3 b) of Law 34/2002 on Services of the Information Society and Electronic Commerce, as well as what is established in RD 1906/1999 . The parties agree to legally equate the client's handwritten signature to that made using any type of keys, codes or identifying security elements. Notwithstanding the foregoing, Andrea Ramos García may require written confirmation when deemed necessary.

14. NULLITY OF THE CLAUSES.
If any provision of this contract becomes illegal, invalid or unenforceable for any reason, said illegality, unenforceability or lack of validity will be limited exclusively to that provision and will not affect the validity or enforceability of the other provisions

15. APPLICABLE LAW AND JURISDICTION.
Conflicts that may arise from the application of these rules will be governed by the laws of Spain and, to the maximum extent permitted by law, will be submitted to the Courts of Burgos.
